Ban sa ‘adultery’ website iginiit ng DoJ sa Telcos

INIHAYAG ni Justice Secretary Leila de Lima kahapon, iniutos niya sa Department of Justice Office of Cybercrime na pag-aralang mabuti ang mga hakbang na ipatutupad upang tugunan ang illegal na operasyon ng tinaguriang “adultery website” Ashleymadison.com.

Ayon kay De Lima, posibleng hakbang na ipatutupad ng DoJ ang paghiling sa telecommunications companies na i-down o i-ban ang nasa-bing website.

Aniya, hindi na kailangan ang pagpapatupad ng Cybercrime Prevention Law kaugnay sa isyu dahil mayroon nang sapat na mga probisyon sa Revised Penal Code (RPC) hinggil dito.

Aniya, ang adultery ay labag sa batas alinsunod sa RPC.

“Pinapaaral ko ‘yan sa OOC or Office of the Cybercrime although offhand, initially, ang advise ng OOC is we can appeal to the telcos to consider banning cellsites like that so pinapa-research ko. Is there any provision that can provide legal cover for us compelling telcos to precisely do that because it tends to encourage illegal acts?” pahayag ni De Lima.

“You know adultery remains to be punishable under the Revised Penal Code and from what we see and from what we hear from that particular website is that it encourages extramarital affair. It encourages adulterous acts, and adultery is a criminal act punishable under our general criminal law,” dagdag ng Kalihim.

Ang Ashley Madison, may slogan na “Life is short. Have an affair,” ay inilunsad kamakailan sa website nito sa Filipinas, na ang nakararami sa populasyon ay pawang mga Katoliko at hindi ipinaiiral ang diborsiyo.

Ayon sa local press reports, halos 2,500 Filipinos na ang nag-signed up sa website magmula nang ito ay ilunsad.

Ang adultery at concubinage ay may katapat na parusang anim buwan pagkabilanggo ayon sa batas ng Filipinas.
