Amnestiya sa political prisoners giit ni Agcaoili

IGINIIT ni bagong talagang NDFP Negotiating Panel Chairperson Fidel V. Agcaoili sa administrasyon ni Pangulong Rodrigo Duterte ang pagkakaloob ng amnestiya sa 432 political prisoners.

Inihayag ito ni Agcaoili sa inilabas niyang opening statement bilang bagong chairperson ng panel.

Ayon kay Agcaoili, ipagpapatuloy niya ang mga polisiya at rebolusyonaryong pagkilos sa usapang pangkapayapaan na sinimulan ng kanyang pinalitan sa puwesto na si Luis Jalandoni, ngayon ay senior adviser.

Gayonman, aminado si Agcaoili na hindi niya ginusto ang nasabing tungkulin. Kontento na aniya siya sa pagiging ordinaryong miyembro ng Panel, at minsan ay itinalagang emisaryo sa GRP, noon kay dating Pangulong Cory Aquino at Fidel Ramos at ngayon ay kay Pangulong Rodrigo Duterte.

Ngunit tininiyak ni Agcaoili na gagawin niya ang lahat nang kanyang makakaya para maipatupad ang tungkulin na nakaatang sa kanyang balikat.

Ang kanyang opening statement ay nakatuon sa isyu ng pagpapalaya sa lahat ng political prisoners “as a matter of justice” at bilang pagsunod sa Joint Agreement on Safety and Immunity Guarantees (JASIG) at sa Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL).

Aniya, ang pinaka-epektibong paraan nang pagpapalaya ay sa pamamagitan ng amnesty proclamation na mismong alok ni Pangulong Duterte.

“The release of all political prisoners through amnesty was offered by President Duterte during my first meeting with him on 16 May 2016 in connection with the resumption of the peace negotiations.  Compared to the various methods that I had recommended, such as archiving, bail, release on recognizance, etc., he stated that granting amnesty would be the most effective mode in releasing the JASIG-protected persons, the sick, elderly, women and long-term detainees for humanitarian reasons, and all the political prisoners,” pahayag ni Agcaoili.

Dagdag ni Agcaoili, ang alok ay ginawa ni Duterte sa harap ng kasalukuyang mga miyembro ng GRP Panel, at kongresista na kanilang kasama sa nakaraang mga pag-uusap bilang miyembro ng delegasyon ng Kamara, at iba pa.

Aniya, binanggit niya ito bilang paglilinaw na ang inalok na amnesty proclamation ay patungkol sa political prisoners at hindi general amnesty na “mutually extended” sa puwersa ng magkabilang panig sa final settlement ng armed conflict.

“We should not muddle these two amnesty concepts, lest we be accused of intending to make use of the political prisoners as a leverage or hostage to secure advantage across the negotiating table or to demand capitulation of one side by another,” aniya.

Dagdag niya, ang pagpapatuloy na pagkakapiit nang mahigit 400 political prisoners ay patunay ng kawalan ng hustisya. Hindi aniya ito tugma sa rehimen na nagnanais magdulot ng pagbabago sa pamamagitan ng pagpapatupad ng usapang pangkapayapaan sa kilusang rebolusyonaryo at Moro people.

“We should bear in mind that their continuing detention is a blatant violation of the CARHRIHL.  They are unjustly detained on trumped-up charges of common crimes in violation of the Hernandez political offense doctrine that has been enshrined in the CARHRIHL. President Duterte himself in his conversation with NDFP lawyers and GRP Panelists on 15 August 2016 in Malacanang Palace, reaffirmed his belief in the correctness and justness of the 1956 Philippine Supreme Court decision on the case against Amado V. Hernandez on rebellion complex with common crimes,” aniya.

Naninindigan aniya ang NDFP sa panawagan na amnestiya para sa 432 political prisoners, hindi lamang bilang paggawad ng hustisya kundi bilang pagsunod sa CARHRIHL.

Ang pagpapalaya aniya sa kanila ay magsisilbing insentibo sa pagsusulong ng usapang pangkapayapaan at pagbubuo ng higit na matatag na ceasefire agreement.

“I hope we can resolve these crucial issues so that we can move forward,” aniya.
