Sexual partners na kaanak parurusahan

MAGKAKAROON na ng parusa ang incestuous affair o relasyong sekswal ng mga miyembro ng pamilya, 18-anyos pataas, kapag naisabatas ang panukalang Anti-Incest bill.

Ang House Bill 3329, inihain ni Cagayan de Oro representative Rufus Rodriguez at kapatid niyang si ABAMIN party-list Representative Maximo Rodriguez Jr., ay naglalayong maparusahan ang mga nasangkot sa incest relationship

Sinabi ni Rodriguez, kailangan ang Anti-Incest law upang tugunan ang tumataas na bilang ng incestuous relationships na nagaganap sa pamilya ng mga overseas Filipino worker (OFWs).

Sa ilalim ng Articles 37 at 38 ng Family Code of the Philippines, ang incestuous marriages ay “void ab initio—from the beginning—for being contrary to public policy”.

Samantala, sa Anti-Rape Law of 1997, may parusang kamatayan sa panggagahasa kung ang biktima ay wala pang 18-anyos at ang suspek ay kamag-anak sa loob ng third civil degree, o kung ang suspek ay common-law spouse ng magulang ng naabusong indibdwal.

“However, there is no law which penalizes sexual relations between consenting parties 18 years of age and above,” diin ni Rodriguez.

Nakasaad sa HB 3329, “incestuous sexual relations with consent between ascendants and descendants of any degree, as well as between brothers and sisters whether of the full or half blood will be prohibited and considered unlawful”.

Kabilang sa ipagbabawal ang pagkakaroon ng incestuous affairs ay ang “in-laws, stepparents and stepchildren, adoptive parents and their children, as well as collateral blood relatives, whether legitimate or illegitimate up to the fourth civil degree”.

Ang lalabag ay parurusahan ng prision correccional, o makukulong ng mula anim buwan hanggang anim na taon.

“The maximum penalty shall be imposed should the court prove that the incestuous relations occurred while the spouse of the ascendant, the stepparent, parent-in-law, adopting parent, or the adopted is employed in another city, municipality or province, within a radius of at least 150 kilometers from his or her habitual residence or is employed abroad,” ayon pa sa panukala.

Sa ulat ng Center for Migrant Advocacy noong 2008, ang “incest” ay katotohanan na hinaharap ng ilang OFW families bunsod ng pagkakalayo ng ama o ina dahil sa pagtatrabaho sa ibang bansa.

Gayonman, aminado ang grupo na walang sapat na data para mabatid kung gaano kaseryoso ang nasabing suliranin. (HNT)
