TRO vs JVA ng CENECO, Primelectric ibinasura

IBINASURA ng Bacolod Regional Trial Court (RTC) ang apela na magpalabas ng Preliminary Injunction at temporary restraining order (TRO) upang pigilan ang joint venture agreement (JVA) na nilagdaan noong 3 Hunyo 2023 sa pagitan ng Central Negros Electric Cooperative (CENECO) at Primelectric Holdings Inc.

Sa tatlong-pahinang desisyon ng korte, sinabi ni RTC Branch 6  Presiding Judge Maria Lina Gonzaga, nilabag ng petitioner na sina Pepito Pico, Rommel Pido, at Aaron Sorbito ng Negros Consumers’ Watch (NCW) at Convenors of Anti-CENECO JVA Coalition (ACJC) ang proseso sa paghahain petisyon sa korte.

Sinabi ng hukom na si Gonzaga, batay sa record ay lumitaw na hindi nabigyan ng kopya ng petisyon ang mga respondents sa kaso na kinabibilangan ng CENECO Board of Officers sa pangunguna ng Pangulo nitong si Jojit Yap at mga Board members na sina Ariel Guides, Eugenio Velasco, Antonino Panique, Dwight Carbon, Noel Alarcon, Nicanor Jison; ang Primelectric Holdings Inc., at Negros Electric Power Corporation na kapwa kinakatawan ni Roel Castro.

Ayon sa korte, isa sa pangunahing proseso sa isang aplikasyon na humihiling ng TRO ay dapat alam ng kabilang panig, sa nasabing kaso ay hindi nabigyan ng notice ang adverse party.

“When an application for a writ of preliminary injunction or a temporary restraining order is included or a temporary restraining order is included in a complaint or any initiatory pleading, the case, if filed in a multiple-sala court, shall be raffled only after notice to and in the presence of the adverse party or the person enjoined,” pagkaklaro sa desisyon.

“In any event such notice shall be preceded or contemporaneously accompanied by service of summons together with a copy of the complaint or initiatory pleading and the applicant’s affidavit and bond, upon the adverse party,” saad sa desisyon.

Dahil sa hindi pagsunod sa tamang proseso na itinatakda ng batas ay ibinasura ang petisyon.

“For non-compliance with the specific provision of the law, the application for the issuance of Temporary Restraining Order (TRO) is denied,” ayon sa desisyon na inilabas nitong 22 Hunyo.

Ang JVA sa pagitan ng CENECO at Primelectric Holdings Inc., ay naglalayong maisalba ang power industry sa Negros, nasa P4 bilyong investment ang ilalaan para sa modernisasyon kasama rito ang pagbili ng assets at budget para sa capital expenditures (Capex).                          

Nasa 1,000 barangay leaders, business groups, multi-sectoral groups at maging ang lokal na pamahalaan ang pabor sa nabuong JVA para tuluyan nang maresolba ang problema sa elektrisidad sa rehiyon kabilang dito ang madalas na nararanasang brownout at mataas na presyo ng koryente dala ng systems loss na umaabot sa P20 milyon kada buwan.

Umaabot sa 220,000 ang CENECO consumers, 70 percent nito ay nasa Bacolod City habang ang 30 percent at nasa mga lungsod ng Talisay, Silay, Bago, Murcia, at Don Salvador.

Ang JVA ay nakatakdang isalang sa referendum sa 24 at 25 ng Hunyo; at sa 1 at 2 ng Hulyo 2023.
