Isyu ng pag-eespiya vs third telco uminit sa lawyers online forum

WALANG cybersecurity measure na 100 percent fool-proof, ayon sa lawyers’ advocacy group na Tagapagtanggol ng Watawat.

Sa isang webinar na ini-host ng Philippine Bar Association (PBA) kamakailan, hinikayat ng lawyers’ group ang mga kasamahan para “gawin ang lahat ng pag-iingat laban sa panghihimasok sa ating internet connectivity sa pamamagitan ng pagbusisi sa safeguards na iniulat na inilagay sa sinelyohang  kasunduan para magtayo ang Dito Telecommunity ng cellular towers sa loob ng military camps.”

Ang Dito, third telco na 40 porsiyentong pag-aari ng state-owned China Telecom, ay binigyan kamakailan ng prankisa ng Kongreso.

Ang TNW advocates ay nagbigay ng reaksiyon sa pahayag ni Defense Sec. Delfin Lorenzana na tiniyak ng AFP ang safeguards o mga pananggalang laban sa security breaches tulad ng radio frequency eavesdropping, interception, jamming, at data farming.

“The government must also explain in more details why we are departing from the trend set by various technology giants and developed countries like Australia, U.S. and Japan on freezing out Chinese technologies because of espionage concerns,” ani Atty. Marlon Anthony Tonson, TNW founding member, maliwanag na patungkol sa pagsang-ayon ng gobyerno sa partnership ng Dito sa China Telecom.

Tinukoy ni Tonson ang report ng US-Israeli cybersecurity firm Cybereason na nagsiwalat sa “well-documented attempts na i-hack ang systems ng mahigit isang dosenang global telco firms sa 30 bansa at kunin ang maraming personal at corporate data.”

“We have to acknowledge the apparent vulnerabilities of our digital system as the pandemic forces us to hastily shift to online modes of commerce and work,” pagbibigay-diin ni Tonson.

Pangunahing paksa sa webinar ang inaprobahang House Bill 78, na magbibigay-daan para makakuha ang mga dayuhang kompanya tulad ng China Telecom ng 100 percent ownership sa telco business sa bansa.

Pawang sumang-ayon ang mga dumalo sa webinar na kinabibilangan nina dating Supreme Court chief justice Antonio Carpio, Tonson at iba pang top legal luminaries sa bansa na ‘unconstitutional’ ang inaprobahang House bill.

Binatikos ni Tonson ang HB 78 at sinabing,  “the Constitution cannot be changed by mere act of Congress.”

Ipinaliwanag niya na ang telco ay isang public utility kaya ang 60-40 ownership para sa Filipinos tulad ng nakasaad sa Konstitusyon ay angkop at hindi maaaring baguhin ng kapangyarihan ng Kongreso.

Idinagdag ni Tonson: “HB 78, which has yet to pass the Senate’s approval, is clearly intended to avert the Constitution’s foreign ownership rules for public utilities, the effect of which, is Dito’s efforts can serve as template for the further opening of the telco industry to foreigners, including those adversarial to our diplomatic and national security interest.”
